Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State- respondents.
The petitioner claims that he was suspended upon serious allegations by order dated 20.5.1998. However, he was reinstated in the year 1999 and ultimately retired in 2005 from the post of Kanoongo.
It is claimed that after retirement other benefits have been given but the pension is not extended to the petitioner in spite of various representations having been made to the authority concerned.
The writ petition is disposed of with the direction to the respondent no.3 to consider the claim of the petitioner with regard to payment of pension and pass appropriate orders in accordance with law. In case, it is found that the petitioner is not entitled the same for some valid reason, reasons thereof would be communicated to the petitioner. The representation would be filed by the petitioner along with the certified copy of this order before the authority concerned within ten days from today and the respondent no.3 shall consider the same within a period of three months thereafter.
