Heard learned counsel for the petitioner and learned standing counsel for State - respondents.
In substance, the petitioner appears to be aggrieved by illegal encroachment made by the respondent nos. 4 to 6 over Gata No. 81-Ka, area 0.0480 hectare and Gata No. 90-Ka area 0.0510 hectare situated at Village - Bela Kasaila Kotiya, Tehsil - Madhuvan, District - Mau. The petitioner has made representation dated 30.10.2017 for removal of the aforesaid illegal encroachment before the Sub Divisional Magistrate, District - Mau (Annexure No. 3 to the writ petition).
No useful purpose will be served in keeping the writ petition pending. This writ petition is disposed of with a direction to the respondent no. 3, the Sub Divisional Officer, to decide the petitioner's representation dated 30.10.2017, in accordance with law, within a period of 3 months from the date of presentation of a certified copy of this order.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
