By the order dated 15.5.2019 the Principal, Moti Lal Nehru Medical College, Prayagraj has declared the summer vacation from 16.05.2019 to 31.05.2019. As per the order dated 15.05.2019, the second phase of the summer vacation is to commence from 01.06.2019 to 15.06.2019.
It is contended by Sri Udayan Nandan, learned counsel for the petitioners that the order dated 15.05.2019 is inconsistent with the Government Order dated 18.08.1973. It is further submitted that the Government Order dated 18.08.1973 is still in vogue and has not been repealed or superseded. These facts were brought to the notice of the Principal, Moti Lal Nehru Medical College, Prayagraj by the petitioner in their making a formal representation. However, no action has been taken on the said representation.
Learned Standing Counsel submits that since the representation relates to verification of certain factual aspects, it would be apposite in the interest of justice for the respondent No.3- Principal, Moti Lal Nehru Medical College, Prayagraj to first decide the representation after giving due consideration to the grievances raised by the petitioner.
With consent of the learned counsel for the parties, the writ petition is being disposed off finally.
The matter is remitted to the respondent No.3- Principal, Moti Lal Nehru Medical College, Prayagraj.
The respondent No.3-Principal, Moti Lal Nehru Medical College, Prayagraj is directed to decide the representation of the petitioner regarding inconsistency of the order dated 15.05.2019 passed by the Principal, Moti Lal Nehru Medical College, Prayagarj with the Government Order dated 18.08.1973. The respondent No.3 shall also consider any other Government Orders or provisions of law which are relevant to the controversy at hand. The respondent No.3- Principal, Moti Lal Nehru Medical College, Prayagarj shall decide the representation by a reasoned and speaking order within a period of one week from the date of receipt of a certified copy of this order.
With the aforesaid direction, the writ petition is finally disposed off.
