Heard learned counsel for the petitioner and Shri Tariq Maqbool Khan as also learned Standing Counsel for the State- respondents.
The writ petition has been filed seeking the following relief:-
"a) To issue a writ order or direction in the nature of Mandamus commanding the respondents to renew the lease of ponds of Gata No. 0.479Ka/0.340 hect. and 480Kha/0.0344 hect. situated in village Laxmipur Ekdanga, Tehsil-Sadar, District Maharajganj for fish rearing."
It is settled law that a fisheries lease is to be granted only on the basis of a public auction. There exists no provision for extension of a lease. This Court in the Full Bench in Ram Kumar has categorically held as above.
Under the circumstances, the relief prayed for in the writ petition cannot be granted in any circumstance.
The writ petition is, therefore, misconceived and is dismissed.
