ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader appearing for the respondents.
This Writ Petition was filed challenging action of the respondents 4 and 5 in harassing the petitioner by calling him to Police Station and to the office of the fourth respondent.
The petitioner states that on 24.10.2008 at about 10.00 AM the fourth respondent and his staff came to his house and took him to his office and detained therein without any reason therefor. When the fourth respondent did not respond for his release, his wife filed Writ petition No.23688 of 2008 and subsequently the fourth respondent released him from illegal custody. Thereafter, cases in Crime Nos. 4487 to 4492 of 2008 were registered against him and he was enlarged on bail by the learned Additional Sessions Judge, Warangal. Though the petitioner made these allegations against respondents 3 and 4, he sought relief against the fifth respondent.
Fifth respondent filed a counter affidavit stating that no complaint whatsoever is received or registered against the petitioner on the file of the Ghanpur mandal Police Station, Warangal. He further stated that they never summoned the petitioner to the police station nor made him to wait in the police station at any point of time.
In view of the aforesaid statements of the fifth respondent in the counter affidavit, no cause survives for adjudication in the Writ Petition and therefore the Writ Petition is liable to be dismissed as infructuous.
The Writ Petition is dismissed as having become infructuous. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
