HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.6289 of 2014 Order:
The petitioner seeks for quashment of First Information Report (FIR) in Crime No.185 of 2014 on the file of III Town Police Station, Eluru, West Godavari District. The petitioner allegedly committed the offences under Section 324 read with Section 506 IPC. The case is at the stage of investigation. It may not be appropriate to interfere with the investigation at this stage. At the same time, where it is alleged by the petitioner that a false case was foisted against him, it would be appropriate to direct the Police not to arrest the petitioner during the pendency of investigation.
2. Accordingly, this criminal petition is disposed of directing the Police to proceed with the investigation of the case in Crime No.185 of 2014 on the file of III Town Police Station, Eluru, West Godavari District but not to arrest the petitioner during the pendency of investigation. The miscellaneous petitions, if any, pending in this petition shall stand closed.
