Most Rev.V.S.Isaac Aiyya vs The Director

Madras High Court|06 February, 2017

JUDGMENT / ORDER

By consent, this Writ Petition is taken up for final disposal.
2. The petitioner claims that he is the Chairman of Isaac Christian Institute of Professional Education and the said Trust is running a College under the name and style of V.S. Issac Teacher Training Institute conducting DTED, B.Ed. and M.Ed. Course. The petitioner would further aver that the petitioner institution is a religious minority institution located in a rural area surrounded with illiterate people and in pursuant to grant of recognition by the National Council for Teacher Education (NCTE), Southern Regional Committee dated 30.06.2007, they have admitted 50 students through Single Window System and apart from that 50 students were also admitted under management quota and every year, recognition is being renewed by NCTE. The grievance expressed by the petitioner is that despite grant of recognition by NCTE, approval has not been given by the first respondent and in this regard, the petitioner has also submitted a representation dated 27.12.2016 and though it was received and acknowledged, no orders have been passed and hence, came forward with this writ petition.
3. The learned counsel appearing for the petitioner would submit that since the recognition has been accorded by NCTE, there cannot be any impediment on the part of the first respondent to accord approval for conducting courses and therefore, prays for appropriate orders.
4. Heard the submissions of Mr.K.Dhananjayan, learned Special Government Pleader, who accepts notice on behalf of the respondents and also perused the entire materials placed before it.
5. Though the petitioner prays for larger relief, this Court in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner either in his representation or in this writ petition, directs the first respondent to consider and dispose of the petitioner's representation dated 27.12.2016 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
5. This Writ Petition is disposed of accordingly. No costs.
