The Court made the following:
ORDER:
This Contempt Case is filed alleging willful disobedience of order, dated 16.12.2013, in Writ Petition No.36867 of 2013.
The petitioners alleged that contrary to the order passed by this Court, the respondents have demolished the structures on 21.12.2013. The petitioners have, however, not pleaded that before filing this Contempt Case, they have issued notices to the respondents. The Contempt Case being quasi-criminal in nature and the buildings having already been demolished, there was no reason for the petitioners not to issue notices to the respondents before filing this Contempt Case. As the petitioners failed to follow this procedure, I am not inclined to entertain this Contempt Case at this stage. The petitioners are entitled to issue notices to the respondents and if they are not satisfied with the reply that may be issued by the latter, they shall be free to file a fresh Contempt Case.
Subject to the liberty given to the petitioners as above, the Contempt Case is dismissed.
