JUDGMENT / ORDER

The petitioner alleges infraction of Rule 14(3) of the Kerala Land Reforms (Ceiling) Rules, 1970. The petitioner contends that no opportunity was afforded to adduce evidence to substantiate its claim under Section 85(8) of the Kerala Land Reforms Act, 1963 (the Act for short). The claim of the petitioner is based on sale deed (document No. 1228/1973) in respect of 1.12 acres in RS No. 311/1 of Pandallur village. The land board has rejected the claim of the petitioner relying on its earlier order dated 22.02.1985 on an application filed by another under Section 85(8) of the Act.
2. The petitioner contends that the order dated 22.08.1985 is on an application filed by Kidangayam Munavvirul Islam Madrasa under Section 85(8) of the Act. But the petitioner is Moovasathul Muslimine Brothers Association, Kidangayam which is stated to be a different entity. Whether the aforesaid associations are different and whether the order dated 2 CRP (LR) No. 671/2013 22.02.1985 has relevance is a matter for deeper probe.
3. I set aside the order of the Taluk Land Board only in so far as it relates to 1.12 acres of land in Sy. No. 311/1 of Pandallur village. The Taluk Land Board is directed to reconsider the application put in by the petitioner under Section 85(8) of the Act with notice to the affected parties. The needful shall be done within a period of four months from the date of receipt of a copy of this order. It is clarified that the order of the Taluk Land Board impugned in this Civil Revision Petition is confirmed in other respects.
The Civil Revision Petition is disposed of.
