The petitioner had submitted Ext.P1 complaint to the second respondent, alleging nuisance from a shed constructed by the third respondent. The said complaint was enquired into and Ext.P2 notice was issued by the second respondent proposing action against the third respondent. Ext.P2 is dated 28.5.2014. According to the petitioner, no further action has been taken thereon till date. The petitioner has obtained a copy of Ext.P2, pursuant to Ext.P3 request submitted by him. The limited relief sought for by the petitioner is to finalise the proceedings as per Ext.P2. 2. In view of the limited relief sought, I do not consider it necessary to issue notice to the respondents. It is sufficient that this writ petition is disposed of, directing the second respondent to finalise the issue.
In view of the above, this writ petition is disposed of, W.P.(C).No.25955 of 2014 2 directing the second respondent to finalise the proceedings initiated as per Ext.P2, after affording an opportunity of being heard to the third respondent as well as the petitioner and conducting an inspection of the site, if necessary. Orders, as indicated above shall be issued, as expeditiously as possible, and at any rate, within a period of six weeks of the date of receipt of a copy of this judgment.
