JUDGMENT / ORDER

The interim order of injunction as modified was directed to be enforced with police aid as sought by the petitioner in I.A. No. 1734/2012. The Station House Officer was given the liberty to measure the property covered by the order of injunction for the purpose of identification with the help of a Taluk Surveyor or a Village Officer. The Advocate Commissioner deputed in the suit has already filed a report and plan about the property included in the plaint schedule.
2. The petitioner has filed I.A. No. 1612/2013 in O.S. No.
448/2011 to have the report and plan of the Advocate Commissioner remitted. I direct the court of the Subordinate Judge of Thalassery to pass orders thereon within a period of six weeks from the date of production of a copy of this judgment. I hasten to add that the measurement by Station House Officer is only for the limited purpose of identifying the property covered 2 OP(C) No. 1219/2014 by the order of injunction and the court below has not erred in issuing such a direction.
I do not find any error of jurisdiction in the order in I.A. No. 1734/2012 impugned in this Original Petition. The Original Petition fails and is dismissed.
