Heard Sri Rajeev Giri, learned counsel for the petitioner and learned Standing Counsel for respondents State. Notice need not to be issued to respondent no.6, at this stage.
This writ petition has been filed with the following prayer:-
"I- To issue a writ, order or direction in the nature of Mandamus to commanding the respondent no. 2 to decide the representation of the petitioner dated 4.1.2021 (Annexure No. 8 to writ petition) within a stipulated time period.
II- To issue a writ, order or direction in the nature of mandamus direct to the respondent no. 3 and 5 to decide the complaint dated 27.7.2020 and remove the illegal encroachment done by the respondent no. 6 over the pound land (Arazi No. 526) Annexure No. 2 to the writ petition, within stipulated time period."
It is contended that on Gata No. 526, which is recorded as village pond, encroachment has been made. Petitioner has moved an application under Section 67 of the U.P. Revenue Code, 2006 for the removal of the said encroachment but till date it has remained unattended.
Sub Rule 6 of Rule 67 of the U.P. Revenue Code Rules, 2016 provides for the period in which proceedings initiated under Section 67 has to be concluded.
In view of the above, respondent no. 3 is expected to comply the provisions of Sub Rule 6 of Rule 67 of the U.P. Revenue Code Rules, 2016, in accordance with law, after hearing all the concerned parties, from the date of receipt of a copy of this order downloaded from the official website of the High Court.
Writ petition stands disposed of.
