Heard Shri Suresh Bahadur, learned counsel for the petitioners, Shri Brijesh Kumar Sharma, learned counsel for opposite party nos.2, 3 and 4 and the learned A.G.A. for the State.
The instant habeas corpus petition has been filed on behalf of petitioner no.2,Puja through petitioner no.1,Mool Chand who claims himself to be her husband with the prayer to issue a writ in the nature of habeas corpus directing respondent nos. 2 to 4 to produce petitioner, the corpus, Puja before this Court and set her at liberty.
In compliance of the order dated 6.10.2017, the corpus Puja has been produced before this court and her statement has been recorded, in which she has stated that she is major and she has solemnized her marriage with Mool Chand. She also stated that at present she is living with her parents and she does not want to go with her husband Mool Chand.
Considering the statement of the corpus, no question of illegal detention of the corpus is made out. She is at liberty to go with her own choice as she is major. Accordingly, this Habeas Corpus petition is dismissed.
Learned counsel for respondents states that the amount of Rs.10,000/- deposited in the name of corpus Puja towards travelling expenses in compliance of the order dated 6.10.2017 may be released in favour of corpus.Prayer is allowed.
The amount so deposited vide order dated 6.10.2017 shall be released by the Registry in favour of corpus.
