Heard learned counsel for the applicants and learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C., has been filed for quashing the entire proceedings of Complaint Case No. 1928 of 2017 (Viplav Agarwal vs. M/s. Shyama Devi Cold Storage and others), under Section 138 N.I. Act, Police Station Kotwali, District Mathura, pending in the court of Prescribed Officer Additional Court, Mathura.
Application for mediation has already been moved before the lower court, therefore there is no point in sending the matter here for mediation because sending for mediation would ipso-facto invite staying proceeding of the case, which would not be in the interest of justice. Therefore, no relief can be granted, at this juncture. Applicants are directed to approach the lower court.
With the aforesaid direction, the application is disposed of.
