Heard Sri Ashish Kumar Singh, learned counsel for the applicant, Sri G.P. Singh learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer to direct the court below to expedite the hearing on day to day basis in the case arising out of Case Crime No.278 of 2016 (State vs. Monu) under sections 363, 366, 376, 506 IPC and 3/4 POCSO Act, Police Station Garhmukteshwar, District Hapur pending in the court of Juvenile Justice Board, Hapur.
It is contended by the learned counsel for the applicant that the applicant is an accused in this case, who is lying in jail 13.7.2016 and till date lot of delay has already occurred in disposal of the case. It took too long for him to be declared a juvenile. He has prayed that a direction may be issued to expeditiously decide the case within stipulated time.
Learned A.G.A. has no objection if such a direction being issued by this Court.
Perused the order sheet which shows that there is no delay on the part of the accused and looking to the fact that he is lying in jail since long, it is directed that the Juvenile Justice Board shall make all endeavour to decide the case expeditiously preferably within a period of six months from today, if there is no legal hurdle, without permitting undue adjournments to either side.
With this direction, this application is disposed of without issuing any notice to opposite party no.2 as it is an innocuous order. If the opposite party no. 2 feels aggrieved, he may approach this Court.
