This is the second bail application.
Supplementary affidavit filed on behalf of the applicant today, is taken on record.
Heard learned counsel for the applicant, learned AGA and perused the record.
Perusal of the record reveals that at an earlier occasion, first bail application, bearing No. 8902 of 2018 had been been rejected vide order dated 09.03.2018 on merit by this Court.
It is submitted by the learned counsel for the applicant that the applicant is suffering incarceration in jail since 16 months in Case Crime No. 0363 of 2017, under sections 452, 323, 504, 302, 307, 120-B IPC and 7 of the Criminal Law Amendment Act, P.S. Jawan, District Aligarh and till now statements of four witness of fact have been recorded. Except the aforesaid submission, learned counsel for the applicant could not raise any fresh ground in the instant second bail application.
In the circumstances, learned trial court is directed to expedite the trial of Case Crime No. 0363 of 2017, under sections 452, 323, 504, 302, 307, 120-B IPC and 7 of the Criminal Law Amendment Act, P.S. Jawan, District Aligarh and conclude the same in accordance with law, if there is no other impediment. However it is made clear that no unwarranted adjournment shall be granted to either of the parties.
With this observation, the instant second bail application is, hereby, dismissed.
Office is directed to communicate this order by FAX to the concerned trial court within 72 hours.
