These three petitions i.e. Writ Petition Nos. 5730 (M/B) of 2010, 5731 (M/B) of 2010 & 5732 (M/B) of 2010 since arise out of one and same FIR relating to Case Crime No. 51 of 2010, under Sections 498-A, 323, 406, 506 read with Section ¾ D.P. Act, police station Mahila Thana Hazratganj, district Lucknow, as such, are being taken up and decided together.
We have gone through the contents of the FIR, which disclose commission of cognizable offence, as such, the same cannot be quashed.
These writ petitions are misconceived and are accordingly dismissed.
However, it is provided that if petitioner of Writ Petition No. 5730 (M/B) of 2010, namely, Momina surrenders and moves application for bail, the same shall be considered and decided expeditiously by the courts below giving her benefit of Section 437 Cr.P.C being lady.
