Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 & 2 and Sri Sandeep Kumar Rai, Advocate holding brief of Sri Shivam Yadav, for respondent no.3.
The petitioner applied for selection and appointment on the post of Assistant Teacher in an examination of Assistant Teachers Recruitment-2018 as O.B.C. candidate, with preferential districts. The petitioner secured 68 marks and accordingly, she was declared selected for appointment on the said post. The petitioner was called for counselling on 26.07.2019 and 30.07.2019, but due to some personal difficulty, she could not appear in the counselling.
The petitioner sent a letter dated 30.09.2019 to the respondent no.2, Secretary, Basic Education Board, U.P., Allahabad, Annexure 3 to the writ petition, stating her difficulty due to which she could not appear in the counselling, and requested for re-counselling. When the said letter was not paid any heed by the respondent no.2, petitioner has again sent a reminder to respondent no.2 requesting for re-counselling.
The grievance of the petitioner is that respondent no.2 has not yet considered her grievance for re-counselling though there are vacancy in District Bijnor.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.2-Secretary, Basic Education Board, U.P., Allahabad, raising all her grievances within a period of three weeks from today. If there are vacancy in district Bijnor, the respondent no.2 shall consider and decide the claim of the petitioner by reasoned and speaking order within a period of three months thereafter.
With the aforesaid observations, the writ petition is disposed of.
