Heard learned counsel for the parties.
Petitioner came to be granted compassionate appointment on 16 May 2018, pursuant to the judgment and order passed in Moni Devi Vs. State of U.P. and others, Writ - A No. 4216 of 2014, decided on 7 February 2018.
Petitioner, by the instant writ petition, seeks following relief:
"to issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to sanction arrears of salary to the petitioner w.e.f. April 2013 until 17.05.2018 with interest at a rate to be specified by this Hon'ble Court."
Learned counsel for the petitioner submits that since the petitioner was not granted compassionate appointment forthwith and was kept out of employment, therefore, petitioner is entitled to arrears of salary for the period until the date of his appointment.
On specific query, learned counsel for the petitioner is unable to show any provision entitles the petitioner to arrears of salary prior to the date as compassionate appointment i.e. for the period petitioner did not work.
In view thereof, the writ petition being misconceived is accordingly dismissed.
