1. First appeal is already admitted. To be placed for final hearing in due course.
2. In so far as the Civil Application is concerned, on 25.11.2011, this court had granted conditional stay in favour of the appellant on condition that the appellant shall deposit entire amount awarded by the Claims Tribunal under the impugned award.
3. Mr.
Shastri, learned Counsel for the appellant was unable to state whether such amount has been deposited. Previously also, when this appeal was placed before for hearing on 21.2.2012, same situation prevailed. It was to enable the learned Counsel Mr. Shastri to take instructions, that we had adjourned the appeal for further hearing today.
4. Under the circumstances, we proceed on the basis that the condition of depositing awarded amount is not complied with. Stay granted earlier, therefore, stands vacated. Therefore, Civil Application for stay stands dismissed.
