Heard learned counsel for the petitioner, Sri Alok Sharma, learned Standing Counsel appearing for the State respondents and Sri Dhirendra Prasad Maurya holding brief of Sri T.M. Khan, learned counsel appearing for the Gaon Sabha.
Present petition has been filed seeking direction to the respondent authorities to allot the fisheries pond being Gata No. 592kha situated at village Rampur Baghaura, Tehsil Gola, District Gorakhpur.
Submission of learned counsel for the petitioner is that the date fixed for auction was 14.12.2018 and the application could have been accepted uptil that date from 10 a.m. to 2 p.m. He submits that the application of the respondent no. 5 has been received on 21.12.2018 much after the date of auction and as such the same could not have been accepted. He submits that no extension of time has been given.
Learned Standing Counsel submits that all such objections can be considered by the authority concerned while considering the auction on its own merits.
Accordingly, present petition stands disposed of with liberty to the petitioner to raise all such objections before the authority concerned at the time of auction, which, according to the petitioner as stated in paragraph 19 of the petition, is scheduled to take place on 31.1.2019.
With this observation present petition stands disposed of.
