Mr.Pandya, learned APP waives notice of Rule.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to undertake the post death ceremony of the brother of his father-in-law.
It appears from the jail report that the convict after was released on furlough for 14 days had absconded for 15 days and the ground is also not such where his presence is indispensable.
Under the circumstances, the discretion does not deserve to be exercised. Therefore the application is dismissed. Rule discharged.
