1. The present application is filed through jail seeking temporary bail for a period of 60 days so as to trace his father, who happens to be his co-convict and is not traceable after he was released on temporary bail.
2. Learned APP Ms.Jirga Jhaveri was granted time to file an affidavit to place on record the steps taken to trace the absconding convict (father of the present applicant). Learned APP files affidavit of Shri B.J.Swami, Police Sub Inspector, Parole Furlough Squad, Patan, S.P. Office. Besides, learned APP submitted that some of the actions which are required to be taken for tracing the absconding convicts are taken while some of the actions are yet to be taken. On instructions from Shri B.J.Swami, Police Sub Inspector, Parole Furlough Squad, Patan, S.P. Office, learned APP states that those steps will be taken and report will be made to this Court.
3. As the convict wanted temporary bail so as to see that he is able to trace his missing father and as the police is going to trace him, for the present, no orders are passed on this application.
The matter is adjourned to 10.01.2013.
