Heard learned counsel for the applicant and learned A.G.A.
The applicant is accused in case crime No. 562 of 2007 under sections 420, 467, 471 I.P.C. and 41/102 of Cr.P.C. and 411, 414 I.P.C., P.S. Meerapur, District Muzaffar Nagar , pending in the court of learned J.M. Court No.2, District Muzaffar Nagar vide case no. 3188 of 2007. This application has been filed with a prayer that a suitable direction may be issued to the courts below for disposal of the bail application of the applicant on the same day.
After perusing the record and considering the nature of the allegations it is directed that in case applicant moves application for appearance/surrender before the court concerned within 30 days from today on which the court concerned shall fix the date of surrender/appearance, in the meantime the court concerned shall seek the instructions from the prosecution side. In case the applicant moves the application for bail on the day of the appearance or surrender, the same shall be heard and disposed of expeditiously, if possible, on the same day by the courts below.
