Mohmmad vs State

Keeping in mind that the applicant is in jail, trial is directed to be completed within nine months. If trial is not over nine months, applicant is at liberty to file afresh which when filed will be decided on merits, in accordance with law and without being influenced by this order of withdrawal.

In view of the above, learned counsel for the applicant seeks permission to withdraw this application. Permission is granted as prayed for. This application stands disposed of as withdrawn. Rule is discharged.
