The present Second Appeal is of year 1988 and when the same is taken up for final hearing, it is reported that the Registry has not sent the Record and Proceedings of the case. Not only that even the paper book is also not placed alongwith the present Second Appeal and, therefore, this Court is not in a position to go on with the final hearing of the present Second Appeal. It is to be noted that repeatedly this Court has drawn the attention of the Registry/Registrar (Judicial), Shri M.J. Thakkar, to see that in all the matters Record and Proceedings should be sent still for whatever reason, directions are not complied with and this Court is required to adjourn the old matters. Hence, Registrar General is directed to look into the matter and submit the report. Stand over to 04/07/2012.
