1. This contempt petition has been filed for alleged non-compliance/disobedience of judgment and order dated 25.07.2018 passed by the writ-Court in Writ Petition No.21099 (M/B) of 2018 filed by the contemnor-respondents whereby recovery certificate for an amount of Rs.7,77,724/- was sought to be quashed.
The writ-Court, while disposing of the said writ petition, directed the petitioner (present contemnor-respondents) to deposit 25% amount mentioned in the recovery certificate within two weeks and remaining amount in five equal installments. It was also directed that if the petitioner (present contemnor-respondents) fails to deposit any two installments, it would be open to the respondents (present petitioner) to execute the recovery certificate dated 03.07.2018.
2. It is admitted case that the contemnor-respondents have not deposited any of the installments, including 25% of the amount mentioned in the recovery certificate.
3. In pursuance of the judgment and order dated 25.07.2018 the recovery certificate has come in operation and existence and the petitioner has liberty to execute the same under the law.
4. The learned counsel for the petitioner has submitted that the recovery certificate has been sent to the Tehsil.
5. It appears that some property of the contemnor-respondents has been attached.
6. In view of the above, this contempt petition does not survive. It is open to the petitioner to pursue the recovery certificate dated 03.07.2018 and the concerned authority should make endeavour to realize the amount, mentioned in the recovery certificate dated 03.07.2018.
7. With the aforesaid observations/directions, this contempt petition stands disposed of finally.
