Heard learned counsel for the applicant, learned AGA for the State and Shri Kripa Shankar Yadav, learned counsel for the informant and perused the material placed on record.
The instant bail application has been filed on behalf of the applicant, Mohit Verma, with a prayer to release him on bail in Case Crime No.385 of 2019, under Sections 498-A, 323, 504, 506, 326 IPC, and section 3/4 of Dowry Prohibition Act Police Station Kotwali District- Sharanpur during pendency of trial.
The submission is that applicant is the husband of the injured Richa .The marriage between them took place twelve years ago. In the First Information Report time of incident was not mentioned and First Information Report was lodged on 15.6.2019 alleging that hot rice starch was thrown on the victim who received burn injuries. The treatment papers of the victim are brought on record. It is not a case of demand of dowry marital discord.
Learned counsel for the informant has submitted that victim has been deprived of living with her children and she is living with her parents. The children are living with applicant. The victim has been subjected to cruelty.
The applicant is directed to be enlarged on bail for a period of six months on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned .
After four weeks of release on bail, applicant shall deposit a sum of Rs.10,000/- with the Mediation Centre of this Court out which 50% shall be paid to the informant for appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that same may be decided after giving notices to both the parties.
It is directed that Mediation Centre shall decide the matter expeditiously preferably within a period of six months. Thereafter the case shall be listed before the appropriate Bench on 30.3.2020.
The Mediation Centre shall intimate about the fate of mediation to this Court.
After depositing the amount, aforesaid, notice shall be issued to the parties and in the case the aforesaid amount is not deposited within the aforesaid period, the interim bail granted to the applicant shall stand automatically cancelled and he shall be taken into custody forthwith.
