Notice on behalf of opposite parties no. 1 to 3 has been accepted by learned Chief Standing Counsel.
In view of the order proposed, issuance of notice to opposite party no.4 is hereby dispensed with.
Learned counsel for the petitioners submits that in pursuance to the judgment and order dated 05.05.2009 passed in writ petition no. 8253 (S/S) of 2007, Shiva Kant Mishra & others v. State of U.P. and others, the District Inspector of School, Pratapgarh an order dated 06.02.2013. Further submission of learned counsel for the petitioners is that the petitioners' case is squarely covered by the aforesaid Judgment of this Court.
Learned counsel for the petitioner, after arguing at some length, submits that ends of justice would be served if necessary directions are issued to the District Inspector of School, Jaunpur (opposite party no. 3) to examine the claim of the petitioners and decide the same in accordance with law within a time- frame fixed by this court.
Learned counsel for the opposite parties has no objection to the prayer of learned counsel for the petitioners.
Taking into consideration the innocuous prayer of learned counsel for the petitioners, the present writ petition is disposed of finally with the direction to the District Inspector of School, Jaunpur (opposite party no. 3) to examine the claim of the petitioner and if it is found that the same is covered by the judgment and order dated 05.05.2009, passed in writ petition no. 8253 (S/S) of 2007, Shiva Kant Mishra & others v. State of U.P. and others, the benefit of the said judgment will also be extended by the authorities concerned to the petitioners within two months from the date of receipt of a certified copy of this order.
