Heard Shri Navin Kumar Sharma, learned counsel for the petitioners and learned Additional Chief Standing Counsel for the State respondents as well as Shri Daya Ram, learned counsel for respondent nos.3 and 4.
The petitioners are before this Court with request to issue direction to the respondents to consider their request for transfer on mutual ground from Senior Basic School Najarpur Kalan, Block & District Amroha to Senior Basic School Isapur, Block & District Amroha and vice versa.
Learned counsel for the petitioners states that the petitioners have already filed a representation dated 31.1.2018 before the respondent no.4 for redressal of their grievance, which is still pending. He has confined his prayer only to the relief that the petitioners' representation dated 31.1.2018 may be considered by the appropriate authority.
Shri Daya Ram, learned counsel for the respondent nos.3 and 4 has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case sand with the consent of parties, this writ petition is disposed of finally with a direction to the District Basic Education Officer, Amroha to decide the petitioners' representation in accordance with law within a period of six weeks from the date of production of a certified copy of this order before him.
