Heard learned counsel for the petitioner; the learned Standing Counsel for the respondent no.1; Sri Vivek Verma for the respondents 2 and 3; and perused the record.
This petition has been filed for a direction commanding the Vice- Chancellor, Mahatma Jyotiba Phule Rohil Khand University, Bareilly (respondent no.2) to approve the transfer of petitioner as L.L.B. Ist Year student from K.G.K. College, Moradabad to Bareilly College, Bareilly on a mutual transfer basis with one Pinki Diwakar, who happens to be a student of Bareilly College, Bareilly, as per proposal of the Principal of respective colleges.
Sri Vivek Verma, who appears for the respondents 2 and 3, has obtained instructions from the University and, on the basis of his instructions, has informed the Court that according to the admission rules there cannot be such a transfer as sought by the petitioner and the proposal sent by the Principal of the colleges concerned has already been disapproved by the Vice-Chancellor on 21.12.2017.
In view of the above, the petition, as framed, has been rendered infructuous and therefore no relief can be granted to the petitioner on the prayer made.
Accordingly, this petition is disposed of by giving liberty to the petitioner to take notice of the subsequent developments and, if advised, to file a fresh petition.
