The appellant is present in person along with his counsel. Despite the notice being sent by registered post to the respondent fixing 20.8.2014 asking her to appear in person, neither she is present in person nor any one has put the representation or filed Vakalatnama.
List on 15.9.2014. On that day, both the parties shall appear in person.
Learned counsel for the appellant states that appellant is paying a sum of Rs.3,000/- under Section 125 Cr.P.C. The court below has fixed a sum of Rs.5,000/- towards maintenance without any adjustment of the amount, which is being paid under Section 125 Cr.P.C.
In view of the above, we direct the appellant to pay a sum of Rs.5,000/- after the adjustment of the amount, which is being paid under Section 125 Cr.P.C. till the next date of listing.
