Heard Sri Gulrez Khan holding brief of Sri J.H. Khan, learned counsel for the appellant and Sri Virendra Kumar holding brief of Sri A.K. Singh, learned counsel for the respondent.
This is a joint application filed on behalf of both the parties that the appeal be decided in terms of compromise entered into between them. The compromise has been verified by the lower court on 31.7.2018.
Accordingly, the judgment and decree passed by the lower appellate court dated 10.5.2007 in Civil Appeal No. 34/2005 is hereby setaside. The appeal is allowed in terms of compromise, which shall form part of the decree.
