1. Heard Sri Rajiv Gupta, learned counsel for petitioner, learned Standing Counsel for State-respondent and Sri Awadhesh Kumar Saxena, learned counsel for respondent no. 3.
2. Dispute raised in this petition is with respect to demand of assessment raised by Assessing Authority on the allegation of electrical theft at the premises owned by petitioner.
3. Admittedly, against assessment order passed by Assessing Authority under Section 126 of Electricity Act, 2003 (hereinafter referred to as 'Act, 2003), petitioner has statuary remedy of appeal under Section 127 of Act, 2003.
4. When questioned, learned counsel for the petitioner could not dispute that the said order is appealable.
5. Dismissed on the ground of alternative remedy.
