Heard Sri Bijai Prakash Tiwari, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application has been moved by the accused-applicant Mohd. Talib, who is involved in Case Crime No. 26 of 2018, under Section 3/5/8 of Cow Slaughter Act, Section 11 of Prevention of Animal Cruelty Act and Section 429 of IPC Police Station - Adalhat, District - Mirzapur.
As per prosecution version, on 28.01.2018 at about 07.40 P.M., the applicant was arrested by the police for slaughtering bovine.
It is contended by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. There is no public witness of the alleged recovery. The applicant has no criminal antecedents and he is languishing in jail since 28.01.2018.
Learned counsel for the applicant further contended that co- accused Kallu has been admitted to bail vide order of this order dated 21.03.2018 passed in Criminal Misc. Bail Application No.
- 10044 of 2018 (Kallu v. State of U.P.). Hence, the present applicant is also entitled to be granted bail.
Per contra, learned A.G.A. has opposed the prayer for bail.
Without commenting on the merits of the case, considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant - Mohd. Talib be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
