Heard Sri Ashish Kumar Gupta, learned counsel for the appellants and Sri Abhinav Prasad, learned AGA for the State.
The correction application is allowed and the order dated 28.5.2019 is corrected as follows:-
In the second paragraph of the order dated 28.5.2019 "Case No.925/2018(State v Shailesh Kumar) pending before the Addl. CJM, Room No. 3, Varanasi including charge sheet No.A352/2017 dated 2.12.2017 submitted by I.O. before the Addl.CJM, Room No. 3 Varanasi in Case Crime No. 290/2017, under section 498-A,323,504,506,427 IPC and 3/4 of D.P. Act, 1961, Police Station- Bhelupur, District- Varanasi as well as order of cognizance dated 23.6.2018 passed by the Addl. CJM, Room No. 3, Varanasi." be deleted and the same shall be read as "Charge sheet dated 1.4.2015 & Cognizance taking order dated 23.1.2017 passed by the learned Additional Chief Judicial Magistrate, Court No.3, Varanasi in Case No.402 of 2017 (State Vs. Mohd. Shareef and others) arising out of Case Crime No.375 of 2014, under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Bhelupur, District Varanasi, pending in Court of learned Additional Chief Judicial Magistrate, Court No.3, Varanasi".
As prayed by learned counsel for the applicants, two weeks further time from today is granted to the applicants to deposit the amount pursuant to the earlier order of this Court dated 28.5.2019.
In case the applicants do not deposit the amount pursuant to order dated 28.5.2019 within the extended period, no further time shall be granted.
