Heard learned counsel for the applicant in this transfer application.
It appears that the plaintiff in the suit filed by the applicant an interim injunction has been granted.
The contention of counsel for the applicant is that this interim injunction was being violated as constructions were being raised by the defendants. The applicant plaintiff therefore, filed an applicant for issuance of a commission to establish violation of interim injunction but no order has been passed on this transfer application.
It is on this ground the transfer of the suit has been sought, by means of this transfer application In case, some application requires expeditious disposal, it is always open for the applicant to seek directions in this regard. This, by itself, does not appear to be a valid ground for transfer of the suit.
Subject to the above observations, this transfer application is accordingly rejected.
