Heard Sri Rakesh Tripathi I learned counsel for the petitioner, Sri A.N.Mulla, learned AGA and perused the impugned F.I.R, as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R, dated 19.6.2018 registered as Case Crime No. 305 of 2018, under sections 379, 411 IPC and Sections 26, 41, 42, 52 of Indian Forest Act P.S. Bilaspur District Rampur.
The submission of the learned counsel for the petitioner is that he is only the owner of the truck, cannot be made liable for any overt act by his driver, does not merit any acceptance as his involvment can not be ruled out at this stage.
Learned A.G.A. also pointed out that the report dated 16.1.2019 of P.S. Bilaspur indicates that the petitioner is also involved in the overt act.
No good ground is made out to quash the FIR, writ petition lacks merit and is accordingly, dismissed.
