Heard learned counsel for the petitioner.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) Direct the Respondent No.1 to decide the application 135-C Under Order 23 Rule 1 of C.P.C. for withdraw the suit O.S. No.960/2009, Mohd. Shahid Vs Shafeeq Ahmad & Others a suit for partition filed by the petitioner pending in the Court of Civil Judge (Senior Division) Jaunpur within stipulated period fixed by this Hon'ble Court."
In view of the above, the petition is disposed of with a direction to the court concerned to decide the above pending application strictly in accordance with law and after giving full opportunity of hearing to all the concerned parties, as expeditiously as possible preferably within a period of two months from the date of production of copy of this order.
It is clarified that the procedure prescribed for deciding such suit, shall be religiously complied with and priority shall be fixed in the order in which other pending suits, if any, have been expedited by this Court in the past.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
