Learned counsel for the petitioners does not press this petition on behalf of petitioner no. 1, Mohd. Sameer alias Nazakat. Hence, the petition is dismissed as not pressed for petitioner no. 1.
Heard learned counsel for the parties and the learned A.G.A. for rest of the petitioners.
This petition is filed by the petitioners for quashing the entire proceedings originated upon the charge-sheet dated 13-06-2018 in Case No. 1878 of 2018, State Vs. Mohd. Sameer @ Nazakat & Others) in Case Crime No. 263 of 2017, under sections 498- A,323,506 I.P.C. and Section 3/4 of the Dowry Prohibition Act, Police Station-Mahila Thana, District-Rampur.
Respondent no. 2, Smt. Nazni, who is present in person in court, states that she has not received any single penny from the petitioners and the abovementioned facts mentioned in the petition are incorrect and false.
After arguing at some length, learned counsel for petitioners submits that grievance of petitioners no. 2 to 6 would be sufficiently met in case bail application of petitioners is considered expeditiously in accordance with law.
In view thereof, it is provided that if the petitioners no. 2 to 6 surrender before the Court below within three weeks from today and apply for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of three weeks, no coercive steps shall be taken against the petitioners no. 2 to 6.
With the aforesaid, the petition is disposed of.
