Heard learned counsel for the applicants and learned A.G.A. for the State.
It is submitted by learned counsel for the applicants that the present matter relates to a matrimonial dispute between the parties. This petition under Section 482 Cr.P.C. has been filed on account of matrimonial dispute between the parties. It is also submitted by learned counsel for the applicants that one case being Criminal Revision No. 4109 of 2018 has also been filed relating to this matrimonial dispute, in which this Court has refer the matter to the mediation centre.
Learned counsel for the applicant requested to refer this matter also to the mediate centre.
It is directed that applicants shall deposit a sum of Rs. 10,000/- within three weeks from today with the Mediation Centre of which 80% shall be paid to the opposite party no.2 for appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of three months after giving notices to both the parties. It is made clear that High Court Mediation & Conciliation Centre, Allahabad shall submit its report by last week of March 2019 positively.
Thereafter the case shall be listed before appropriate Bench.
Till the next date of listing, no coercive action shall be taken against the applicants in Case No.1020 of 2018 ( State Vs. Salim and others) arising out of Case Crime No. 0587 of 2017 and charge-sheet dated 06.04.2018, under Sections 406, 420 I.P.C., Police Station Dibai, District Bulandsahar, pending in the Court of A.C.J.M.
Bulandsahar.
After the aforesaid amount is deposited, notice shall be issued to the parties and in the case the aforesaid amount is not deposited within the aforesaid period, this interim order shall automatically stand vacated.
