Heard.
The writ petition has been filed seeking the following reliefs:-
"1. That the Hon'ble Court may issue writ in the nature of mandamus, and pass necessary direction/order commanding the respondent no. 3 to decide the recommendation/proposal regarding gram panchayat Sherpur Village khand, Leharpur, for creating two new polling booth at 17, primary school, Shahabad, Sitapur.
2. For such further and other orders as the Court may deem fit in the interest of justice and circumstances of the present case and for the enforcement of 'Rule of Law' and for this act of kindness the petitioner shall as in duty bound every pray."
Mr. Akhilesh Singh holding brief of Mr. Anurag Kumar Singh, learned counsel for opposite party no. 4 informs that the question of creation of new polling booth or change of pooling booth can be considered by the District Election Officer before the polling date.
In this view of the matter, the writ petition is disposed of with the observation that the petitioner may approach the District Election Officer raising his grievance. In case any such application is moved the District Election Officer may consider and take appropriate decision in accordance with law before the polling date.
