Heard Shri Mahboob Ahmad, learned counsel for the petitioner and Shri Shakti Dhar Dube, learned counsel for the respondents.
Present writ petition has been preferred against the demolition order dated 5.2.2021 passed by first respondent and the order dated 10.3.2021 passed by second respondent in P.P. Appeal No.29 of 2021 (Saeed Akhtar & Ors. v. The Estate Officer Cantonment Board, Kanpur) by which the interim injunction application has been rejected.
The Court has proceeded to examine the record in question and find that the appeal in question is pending consideration in which next date fixed is 10.4.2021. The Court does not find any good ground to interfere in the matter at this stage. However, it would be open to the petitioner to move appropriate application before the appellate court for expediting the appeal in question. The petitioner would also be at liberty to raise all the grounds, which have been taken in this writ petition, before the appellate court.
With the aforesaid leave, present writ petition stands disposed of .
