Mohd. Sabir vs State Election Commission,Lko. ...

High Court Of Judicature at Allahabad|27 May, 2021

JUDGMENT / ORDER

Hon'ble Ajai Kumar Srivastava-I,J.
Heard learned counsel for the petitioner, Sri H. P. Srivastava, learned Additional Chief Standing Counsel for the State and Sri Anurag Kumar Singh, learned counsel has put in appearance for the State Election Commission through Video Conferencing.
Admittedly an election petition under Section 12-C of the U. P. Panchayat Raj Act, 1947 is stated to have been filed before the competent authority and the same is pending.
In these circumstances invoking writ jurisdiction of this Court, simultaneous to the pendency of an election petition is impermissible.
We, therefore, decline to entertain the present writ petition for being non maintainable in the eye of law.
It is expected that the proceedings of pending election petition shall be concluded by the competent authority expeditiously in accordance with law.
In view of the observation made above, the writ petition is consigned to record.
