A notice was issued by the Tehsildar intimating the petitioner that he has encroached 4.9 square meter State land which has been challenged directly before this Court under Article 226 of the Constitution of India.
We are of the view that the notice ought to have been responded by the petitioner and its outcome awaited before approaching this Court. No interference in the writ petition is, therefore, called for. However, it is provided that the reply filed by the petitioner, if any, shall be duly considered and appropriate orders would be passed before proceeding any further in the matter.
Subject to the observations made above, this writ petition is consigned to records.
