Heard Sri Bal Ram Gupta, learned counsel for the applicant as well as learned A.G.A. for the State and perused averments made in the first information report and rejection order.
The brief fact of the case is that a raid was conducted in a premise wherefrom a very huge quantity of illicit liquor along with QR-codes, rappers etc. were recovered. It is stated that the applicant was also involved in the nefarious activities of manufacturing illicit liquor and also by supplying fake QR- codes.
Considering the overall facts and circumstances of the case and from the bare reading of first information report, it appears that the applicant is involved in an organized crime along with other accused. Though, his name surfaced in the statement of co- accused, yet his custodial interrogation may be required by the Investigating Officer.
In the light of aforesaid, without expressing any opinion on the merits of the case, considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant- Mohd. Rafeeq Alias Chhotu involved in Case Crime No. 185 of 2019, under Sections 420, 467, 468, 471, 257, 258, 120-B I.P.C., 60/72 Excise Act, 63 Copyright Act, 104 Trade Mark Act and Section 207 Motor Vehicle Act, Police Station- Babupurwa, District- Kanpur Nagar.
Accordingly, the anticipatory bail application is rejected.
However, the applicant will be at liberty to move regular bail application under section 439 Cr.P.C., if so advised.
