Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This Public Interest Litigation has been filed for a declaration that the action of the respondents herein for the proposed granting of leasehold rights to the highest bidders for export slaughtering of the modernized abattoirs situated at Amberpet, Gowlipura, New Bhoiguda and Ramanasthapura, as being illegal, arbitrary, unconstitutional and violation of the principles of natural justice guaranteed under the Constitution of India and against their own affidavit filed before this Hon’ble Court in W.P. No. 1924 of 2007 and pass such other order or orders.
From paragraph-3 of the affidavit filed in support of the petition, it appears that in order to have the aforesaid relief, the following statement and averment is made out:
“I Submit that myself and my family are the traditional butchers at Hyderabad since several decades, as such, I am interested in the affairs of the butcher community and their related matters, including that of the management and maintenance of the abattaiors situated in the twin cities. As the Butchers community is very backward and the same has been notified as Backward Class by the Government of Andhra Pradesh. In fact, their living conditions are very poor and majority of them are financially very weak. In fact, the families of the butcher community are mostly illiterates, as such, mainly dependant on the butchering activity as their source of living. However, as a person know the in and out about the problems of our community, I used to be in frontlines whenever there is social work related to our community people.”
It is thus clear that the action is sought to be brought in the interest of a group of private individuals and it is not a public interest litigation. Under the circumstances, we are unable to entertain this petition. Hence, on this ground alone, we dismiss this Public Interest Litigation.
However, liberty is given to the petitioner to approach the appropriate forum for the remedy of the grievance.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
