The petitioner has prayed for issuing a writ of mandamus commanding the opposite party to make construction over the land i.e. Gata no. 1117 measuring 0.089 situate at Village Ajeet Nagar (Belha Ghat), Pratapgarh Sadar, Tehsil and District- Pratapgarh, on the ground that the land in dispute is recorded in the petitioner's name as he purchased the same from one Manjulata, wife of Ram Khrishna.
The petitioner has brought on record the extract of khatauni of Gata nos. 1416 to 1421 specially which supports the petitioner's contention. Being prima fiacie satisfied with the submission of learned counsel for the petitioner, we, as interim measure, restrain the opposite parties to raise the construction over the aforesaid Gata till further order of this Court.
Four weeks time is allowed to file counter affidavit.
List immediately thereafter.
