This writ petition has been filed, seeking a writ of mandamus, directing the respondent concerned, not to arrest the petitioners, with a further prayer for quashing the impugned F.I.R. dated 27.06.2019 registered as Case Crime No. 274 of 2019 under Sections 498A, 323, 504, 506, 376, 377 I.P.C. and 3/4 D.P. Act, P.S. Cantt ,District Pryagraj.
It is an offshoot of a matrimonial dispute. Learned counsel for the petitioners states that parties are prepared for settlement by way of mediation and the petitioners at their own initiative, are willing and ready to deposit a sum of Rs. 50,000/- to demonstrate their bondafides.
The matter is referred to Mediation and Conciliation Centre of this Court. The petitioners shall deposit a sum of Rs. 50,000/- by way of demand draft in the Centre in the name of "Registrar General A/c, Allahabad High Court Mediation & Conciliation Centre", within three weeks from today before the Mediation Centre of this Court. The said amount shall be handed over to the wife / victim before the Centre. Parties to appear before the Centre on 20.1.2020.
Respondents may file counter affidavit's within six weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List in the week commencing on 18.03.2020 before the appropriate Bench.
Till the next date of listing, no coercive measure shall be taken against the petitioners in connection with aforesaid case.
The office shall issue a certified copy of this order, only upon furnishing the proof of said deposit.
