Sri Awadhesh Kumar Malviya, learned Advocate, appears for respondent no. 2 and 3.
The petitioner is aggrieved by non-payment of salary with effect from November, 2018. The submission is that the petitioner has been engaged on the post of Assistant Pump Chalak in Nagar Panchayat, Dildar Nagar, District-Ghazipur and has been discharging his duties with effect from the date i.e. 1.4.2015 to the satisfaction of his seniors. Salary was paid to him till October 2018, but the same has been stopped orally without assigning any reason. It is further contended that the petitioner has been continuously discharging his duties even after stoppage of the salary.
Be that as it may, the dispute being raised herein are factual in nature and, therefore, requires consideration at the ends of respondent no.3.
For the aforesaid, without expressing any opinion to the merits of the claim of the petitioner, the present petition is being disposed of with the direction to respondent no.3 namely Executive Officer, Nagar Panchayat Dildar Nagar, District- Ghazipur to consider the claim of the petitioner for continuation of grant of salary after from November, 2018 by passing a reasoned and speaking order in accordance with law, preferably, within a period of 6 weeks' from the date of submission of certified copy of this order.
